ORDINANCE NO. 26-3 SHOOTING RANGE VILLAGE OF SPENCER MARATHON COUNTY, WISCONSIN AN ORDINANCE AMENDING SECTION 353 OF THE VILLAGE OF SPENCER CODE OF ORDINANCES WHEREAS, the Village of Spencer owns and operates a public shooting range located at 16263 County Road C in the Town of Spencer for the purpose of providing a safe and controlled environment for the public to engage in lawful target shooting and firearm training, and WHEREAS, residents living in the Town of Spencer in which the public shooting range is located have raised concerns regarding excessive noise associated with the operation of the range and its impact on the use and enjoyment of their property, and WHEREAS, the village board recognizes the importance of both maintaining opportunities for lawful sport shooting and protecting the public health, safety, and welfare, including the reasonable peace and quiet of neighboring residents; WHEREAS, the village board finds that adjusting the hours of operation of the public shooting range is a reasonable means of mitigating noise impacts on nearby residents while preserving the continued operation of the range; WHEREAS, the village board further finds that establishing clearly defined hours of operation for the public sport shooting range will promote predictability and facilitate cooperation between the village, range users, and neighboring residents; WHEREAS, the village board desires to amend the Village of Spencer Code of Ordinances to revise the permitted hours of operation of the public sport shooting range and to provide for enforcement of such hours in order to promote the public health, safety, and welfare; NOW, THEREFORE, the village board of the Village of Spencer, Marathon County, Wisconsin, does hereby ordain as follows: 1. That Section 353-6 entitled “Shooting Range” be amended to read: 353-6 Shooting Range. A. Shooting hours. (1) April through September, Monday through Saturday, 9 a.m. to 7 p.m., Sunday, 10 a.m. to 3 p.m. (2) October through March, Monday through Saturday, 9 a.m. to 4 p.m., Sunday, 10 a.m. to 3 p.m. (3) Closed during the Gun Deer Season. B. Range rules. Persons may shoot at paper or cardboard targets only. No incendiary, exploding, glass, or breakable targets are allowed to be used. All targets must be affixed to a target frame. All garbage, casings and targets must be removed and disposed of properly. Consumption of alcohol is not allowed except when authorized by the village board. Shotguns allowed with steel shot or slugs only. 2. That this Ordinance shall be effective from the date of passage by the village board and publication as provided by law.
