ORDINANCE 2026-2 VILLAGE OF SPENCER MARATHON COUNTY, WISCONSIN AN ORDINANCE AMENDING SECTION 27 OF THE VILLAGE OF SPENCER CODE OF ORDINANCES WHEREAS, the Village of Spencer is a member of a joint municipal court pursuant to an agreement with the Village of Stratford and the City of Marshfield; and WHEREAS, all three member municipalities of the joint municipal court are required, under the terms of the joint court agreement and applicable law, to impose uniform court costs for ordinance violations; and WHEREAS, 2025 Wisconsin Act 113 increased the maximum court cost to $48; and WHEREAS, all three member municipalities of the joint municipal court have agreed to set court costs to the maximum allowable level; and WHEREAS, it is necessary to update the ordinance to reference current Wisconsin State Statues. NOW, THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Spencer, Marathon County, do hereby ordain as follows: 1. Section 27-9 A. is amended to read as follows: Deposits for ordinance violations. The municipal judge shall establish and submit to the city council and village boards for approval in accordance with Sec. 800.037, Wis. Stats., a schedule of deposits for violations of city and village ordinances. Said schedule shall utilize the maximum allowable penalty provided for in Sec. 814.65(1), Wis. Stats. and that the same be imposed for violations of City of Marshfield, Village of Spencer, and Village of Stratford ordinances. 2. Section 27-11 A is amended to read as follows: In general, the Marshfield Area Municipal Court may be abolished at the end of any term for which the judge has been elected, upon action taken by the Marshfield City Council, Spencer Village Board and Village of Stratford to either repeal this section and transmittal of a certified copy of an ordinance abolishing the Marshfield Area Municipal Court to the appropriate filing officer under Sec. 11.0102(1)(c), Wis. Stats. To abolish the court, it is not required that the city and villages take similar action. The act of one of the governing boards to repeal its ordinance in accord with the terms thereof shall be sufficient. In the event the City of Marshfield City Council, Spencer Village Board, and Stratford Village Board deem it to be in their best interests to abolish the joint municipal court created under this section, they shall take such action no less than 60 days prior to the date on which the first nomination papers must be filed for the municipal judge's next term. 3. All ordinances or parts of ordinances in conflict with these amendments, including any prior provisions of Chapter 27 inconsistent with the amendments made herein, are hereby repealed, but only to the extent of such conflict. 4. If any section, subsection, sentence, clause, or phrase of this ordinance or of Chapter 27, as amended, is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions, which shall remain in full force and effect. 5. Effective date. This ordinance shall take effect and be in full force from and after July 1, 2026, and after its passage and publication as provided by law.
