Upon arrival, the officer observed the vehicle to have front end damage. There were tire tracks through the yard leading to a large tree which appeared to have damage. The vehicle’s headlight was laying next to the tree. An individual was located in the driver’s seat of the vehicle. The officer observed there to be a can of beer in the cup holder and also noticed a strong odor of alcohol coming from the vehicle. The driver had red, glossy eyes and a small cut on the bridge of their nose. The driver was asked to exit the vehicle. As they did so, the officer observed that they had no shoes on and were stumbling while walking.

The driver said they had gotten into a verbal argument with their spouse about infidelity. They left the house and went to a friend's house, then came back home. The driver admitted to drinking about 4 or 5 beers at their friend’s house before driving home. The driver denied hitting the tree and said the vehicle had been damaged previously. They claimed they did not know why the headlight was by the tree.

The officer asked if the driver would be willing to do field sobriety tests to make sure they were ok to be driving. The driver said they were home already and were not driving. The officer said they had admitted to driving the vehicle on the roadway, there was an open can of beer in the vehicle, and that they had been drinking prior to driving home. The driver agreed to do the tests as well as a preliminary breath test, the result of which was 0.254.
